INFORMATION ABOUT US

www.unistartr.com is a Site operated by the team from the Faculty of Entrepreneurship and Business, Universiti Malaysia Kelantan.

 

ACCESSING OUR SITE

Access to this Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on this Site without notice. We will not be liable if, for any reason, our site is unavailable at any time or for any period.

From time to time, we may restrict your access to some or all of this Site.

You are responsible for making all arrangements necessary for you to have access to this Site. You are also responsible for ensuring that all persons who access this Site through your internet connection are aware of these terms and that they comply with them.

 

FUNDING MODEL AND PROCESSES

This segment addresses aspects of funding and creating projects — things including how money is collected, whether pledges can be modified or cancelled, and how creators can contact funders to provide rewards.

 

FUNDING MODEL AND PROCESSES

These are the terms that apply when you’re funding a project:

  • The estimated delivery is the creator’s estimate. The month and year listed on each reward is the creator’s estimate of when they will deliver the reward. Therefore, Unistartr cannot give a guarantee that the creator will fulfil by that time. The schedule may change as the creator works on the project. We ask creators to think carefully, set an estimated delivery they feel confident they can work toward, and communicate with backers about any changes.
  • The creator may need to send you questions about your reward. To deliver rewards, the creator might need information from you, like your mailing address or t-shirt size. They’ll request that information after the campaign has succeeded. To receive the reward, you’ll need to provide the information in a reasonable amount of time. Creators should not ask for personal information that is not necessary to provide your reward and should never request sensitive personal information such as your national identification number or payment information. Contact us at unistartr@gmail.com if you receive a request for information that seems inappropriate or excessive.
  • Unistartr doesn’t offer refunds. Responsibility for finishing a project lies entirely with the project creator. Once the money is transferred to the creator’s account, Unistartr doesn’t hold funds on creators’ behalf anymore, cannot guarantee creators’ work, and does not offer refunds.

These are the terms that apply when you’re creating a project:

  • For reward-based projects, we use all-or-nothing model and keep-it-all for donation-based projects. This means that if you opted for reward, we will only transfer the amount raised after deducting applicable fees if your project is successful or reached the funding goal. Whereas, for a donation project, we will transfer all the amount raised regardless of your campaign outcome. However, you’ may also choose both reward and donation for your project. If that’s your preference, you may only get the donation portion if your project is unsuccessful. You will get the full amount if your project is successful. Note that we will deduct the applicable fees first before we transfer the money to you. 
  • We’ll charge our fees before transferring funds into your account. Unistartr and its payment processor provider will subtract fees before transmitting the proceeds of a campaign.
  • Prepare for potential delays. Don’t assume you’ll be able to launch your project when you want; there could be a reason we’re not able to accept it, or a problem that takes time to resolve. Don’t assume you’ll be able to immediately collect your funding; there may be a delay between the end of a successful campaign and your access to the funds. And don’t take any actions in reliance on collecting any of the money pledged until you actually have the ability to withdraw it from your account and spend it on your project.
  • We use English as our default language. You may also use Bahasa Melayu when designing your campaign page and in the project's video. However, we suggest using both languages on your campaign page to ensure your messages are well-delivered to your audiences.

 

FEES

We charge our 3% fee on the amount raised of successfully funded projects. If your project uses the donation model, we will also charge our 2% fee on the amount raised. 

 

INTELLECTUAL PROPERTY RIGHTS

We are the owner or the licensee of all intellectual property rights on this Site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You must not print off copies or download any extracts from any part of the Site unless expressly authorized by us to do so.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

We are not responsible for content posted by third parties on our website (including content posted by investees and investors), including the content of pitches, pitch videos, images and content in the forum. If you believe that any content on our site infringes your intellectual property rights, please send an email to us with the following information: (i) evidence of your ownership; (ii) the exact location of the infringing content and any copies.  We will review your notice and take appropriate action, including removing such content where appropriate. RELIANCE ON INFORMATION POSTED

Commentary and other materials posted on this Site are not intended to amount to advice. We are not liable or responsible for any reliance placed on such materials by you or anyone who you may inform of any of its contents.

 

CHANGES TO THE SITE

We aim to update this Site regularly and may change the content at any time. If the need arises, we may suspend access to the Site, or close it indefinitely. Any of the material on this Site may be out of date at any given time, and we are under no obligation to update such material.

 

OUR LIABILITY

The material displayed on this Site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude:

All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results or the use of this Site, any websites linked to it and any materials posted on it, including, without limitation any liability for:

Loss of income or revenue;
Loss of business;
Loss of profits or contracts;
Loss of anticipated savings;
Loss of data;
Loss of goodwill;
Wasted management or office time;
and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.


This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraud or fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law.

We don’t oversee projects’ performance, and we don’t mediate disputes between users.

 

INFORMATION ABOUT YOU AND YOUR VISITS TO OUR SITE

We process information about you in accordance with our Privacy Policy. By using this Site, you consent to such processing and you warrant that all data provided by you is accurate.

 

VIRUSES, HACKING AND OTHER OFFENCES

You must not misuse this Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful (together “Viruses”). You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to this Site. You must not attack this Site via a denial-of-service attack.

By breaching this provision, you may commit a criminal offence under the Computer Crimes Act 1997. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your rights to use this Site will cease immediately.

We will not be liable for any loss or damage caused by a denial-of-service attack or Viruses that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Site or to your downloading of any material posted on it, or on any website linked to it.

 

LINKING TO OUR SITE AND SCRAPING

You may not link to this Site without our prior written permission.

You may not scrape content from this site and repost such content, either manually or automatically, without UniStartr's prior written consent.

This site must not be framed on any other site without our prior written permission.

We reserve the right to withdraw linking, scraping and framing permission without notice.

JURISDICTION AND APPLICABLE LAW

The Malaysian courts will have non-exclusive jurisdiction over any claim arising from or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These terms of use are governed by Malaysian law.
